Dear Colleagues;
Those who are interested in contract law issues may like to access a draft Code of Australian Contract Law prepared by my colleague Prof Ted Wright and conjoint Newcastle Law School academics Profs Fred Ellinghaus and David Kelly, available at
http://papers.ssrn.com/sol3/papers.cfm?abstract_id=2403603 .
There is an article in the Australian press about the project at
http://www.theaustralian.com.au/business/legal-affairs/code-for-a-simpler-better-contract-law-is-presented/story-e6frg97x-1226854219808#
(although it may be behind a pay wall of some sort by the time you read this!) The Code is partly in response to a project initiated by the former Australian Attorney-General Nicola Roxon, though it may also prove of interest to the current Government. Of
course there is an ongoing academic debate about the value and possibility of codification of the Anglo-Australian common law of contract, but this I think will provide an important basis for further discussion of the issues.
Regards
Neil
